GENERAL CONDITIONS Of USE OF the MyAnnuaire SERVICE:
The general acceptance of these conditions representing the contract accepted between the members and the owner of
MyAnnuaire is caused by a click on the bond “I subscribe without reserve to the
present contract” being reproduced on the page of opening of a MyAnnuaire account.
You will be able to use the MyAnnuaire service only after having accepted this contract.
The subscribers with the MyAnnuaire site will be designated by “the members”.
1 - DESCRIPTION
The MyAnnuaireservice is a service making it possible to the user to manage their list of favorite bonds on line.
The MyAnnuaire service of management of the favorite bonds and the software which is associated for him belong to the owner of MyAnnuaire.
2 - INSCRIPTION
The member commits himself respecting this contract in his entirety without modifying it.
The
member is responsible for the confidentiality of his and his password
access code. The member will have to take care not to communicate to
thirds his access code and to immediately warn MyAnnuaire in the event of use after diversion of his password. MyAnnuaire will procèdera then with the replacement of the password and/or the radiation of the member.
In any event the member will be held for person in charge in the event of use of his password with illegal ends.
3 - USE
The owner of the MyAnnuaire software proposes to the users to manage their list of favorite sites since the MyAnnuaire.com site.
4 - ENGAGEMENT OF THE MEMBER
MyAnnuaire technically ensures the management of the favorite sites of the member, MyAnnuaire is not to in no case responsible for the use that will make the member of it.
The
member commits himself not proposing with the public sites or bonds, of
message, images, texts, of vidéos, sounds or animations or of program
which can harm the image of MyAnnuaire, or not in conformity with the French legislation and/or of his country.
The expressly prohibited topics, contents or subjects are in particular:
Very
reached with the royalties or right to the image, very reached with the
private life of others, any corruption or attempt at corruption of
minors, exploitation of minors, pornographic images of minors, any
image message or pornographic text likely to be read or seen by a
minor, use of image degrading of the body of the man and the woman.
Thus,
the member will have to be particularly attentive with the protection
of the minors, the right to the image and the respect of the royalties,
the insults or slandering, the provocations, the incentive with hatred,
violence, racism, the suicide and more generally with the crime or the
offence, with the apology for the crime and matter negationnists.
For
all the data protected by a right of ownership, the member must obtain
the authorizations preliminary near the holders of rights under the
legal conditions before any reproduction, representation and
communication with the public.
The
member will have in particular to take guard with the fact that URL

The
member commits himself not using the service to diffuse or promote

The

texts, images, programs or sounds diffused by his care via the service.
Thus, the member commits himself discharging
MyAnnuaire from any responsibility with regard to the services or information,
signs, images, graphics, sounds or all other data multimedia which it
will have diffused via the service.
In
particular, the member will be only responsible for any material or
body injury direct or indirect caused by the use of his service.
The member will endorse any litigation which can occur between itself and any third person with present.
On the assumption that the responsibility for MyAnnuaire nevertheless would be retained by a legal authority, the member commits himself answering any complaint.
The member will have to compensate
MyAnnuaire with first request against any action, procedure, complaint, request,
expenses of lawyers, of expertise, expenses tax, are judged, damages
whatever their origin, direct or indirect, and all advances carried
out, dependent on non-observance by itself of any of the engagements
defined in present and/or to the use of his site.
5 - DURATION
This contract between into force as of the inscription of the member and it continues for one unspecified duration.
6 - CANCELLATION
MyAnnuaire reserves
the right to regard this contract as purely and simply automatically
terminated without delay and any formality, without damage of all
damages in the event of non-observance of the one of its clauses.
At the cancellation of the MyAnnuaire account and any end of evidence, the data concerning the directory are preserved confidentially and as filing.
If MyAnnuaire decides to cross temporarily or definitively the service, MyAnnuaire does not need to be furnished proof to its members who will have created a directory free.
MyAnnuaire will be furnished proof simply to the subscribers who will have
subscribe to one of our various services paying and procèderait with
refundings services only bought in the case or the subscriber would not
have enjoyed his purchase.
7 - GUARANTEES
The owner of MyAnnuaire does not guarantee that the
MyAnnuaire service will meet the needs for the member, nor who they will be free
from any interruption, delay, incident of safety or error of operation.
MyAnnuaire will endeavour to guarantee a good quality of service but neither guaranteed service nor engagement of response time brings.
The
member is informed of the particular risks related to the use of
Internet network, and in particular owing to the fact that information
relating to personal data relating to it can be collected and/or
transferred, in particular in countries not ensuring an adequate level
of protection of the personal data.
This contract constitutes the entirety and single contract between the parts, it replaces and cancels all former agreements.
8 - MODIFICATION OF THE CONTRACTUAL CONDITIONS
This contract is available on line constantly on the MyAnnuaire.com site and this in order to make it possible to the member to check the conformity of its site with this contract.
The parts were appropriate that
MyAnnuaire automatically can, to modify its services and/or the terms of this
contract, taking into account in particular the technical evolution of
the service.
9 - APPLICABLE LAW
This contract is governed by the English right.
Any
litigation relating to the validity, interpretation or the execution of
this contract and after failure of any conciliation, will be subjected
to the courts of competent jurisdiction.
10 - RIGHT OF THE TRANSFERS
MyAnnuaire reserves
the right to yield or sub-contract without notice whole or part of the
obligations of this contract. The member cannot in no case to yield the
benefit of whole or part of this contract.

membres et le propriétaire de MyAnnuaire est

Vous

Le
service MyAnnuaire de gestion des liens favoris et le
logiciel qui lui est associé appartiennent au propriétaire de MyAnnuaire.

- INSCRIPTION
Le
membre s'engage à respecter le présent contrat dans son intégralité sans le
modifier.
Le
membre est responsable de la confidentialité de son code d'accès et de son mot
de passe. Le membre devra veiller à ne pas communiquer à des tiers son code
d'accès et à prévenir immédiatement MyAnnuaire en
cas d'utilisation après détournement de son mot de passe. MyAnnuaire
procèdera alors au remplacement du mot de passe et/ou à la radiation du membre.
En
tout état de cause le membre sera tenu pour responsable en cas d'utilisation de
son mot de passe à des fins illégales.

- UTILISATION
Le
propriétaire du logiciel MyAnnuaire
propose aux utilisateurs de gérer leur liste de sites favoris depuis le site MyAnnuaire.com.
4 - ENGAGEMENT DU MEMBRE
MyAnnuaire assure techniquement la gestion des sites favoris du
membre, MyAnnuaire n'est en aucun cas responsable de
l'utilisation qu'en fera le membre.
Le
membre s'engage à ne pas proposer au public de sites ou de liens, de message,
d'images, de textes, de vidéos, de sons ou d'animations ou de programme pouvant
nuire à l'image de MyAnnuaire, ou
non conforme à la législation française et/ou de son pays.
Les
thèmes, contenus ou sujets expressément prohibés sont notamment :
Tout
atteinte aux droits d'auteurs ou droit à l'image, tout atteinte à la vie privée
d'autrui, toute corruption ou tentative de corruption de mineurs, exploitation
de mineurs, images pornographiques de mineurs, toute image message ou texte
pornographique susceptibles d'être lus ou vus par un mineur, emploi d'image
dégradante du corps de l'homme et de la femme.
Ainsi,
le membre devra être tout particulièrement attentif à la protection des
mineurs, au droit à l'image et au respect des droits d'auteur, aux injures ou à
la diffamation, aux provocations, à l'incitation à la haine, à la violence, au
racisme, au suicide et plus généralement au crime ou au délit, à l'apologie du
crime et propos négationnistes.
Pour
toutes les données protégées par un droit de propriété, le membre doit obtenir
les autorisations préalables auprès des titulaires de droits dans les
conditions légales avant toute reproduction, représentation et communication au
public.
Le
membre devra notamment prendre garde au fait que les adresses URL doivent
également respecter le droit des marques et les droits de la personnalité.
Le
membre s'engage à ne pas utiliser le service pour diffuser ou promouvoir des
virus informatiques, chevaux de Troie ou tout autre programme nuisible aux
autres utilisateurs, pour violer des systèmes informatiques et pour perturber
le bon fonctionnement général du service.
Le
membre s'engage expressément à assumer la responsabilité des textes, images,
programmes ou sons diffusés par ses soins par l'intermédiaire du service.
Ainsi,
le membre s'engage à décharger MyAnnuaire de
toute responsabilité en ce qui concerne les services ou informations, signes,
images, graphismes, sons ou toutes autres données multimédias qu'il aura
diffusé via le service.
En
particulier, le membre sera seul responsable de tout préjudice direct ou
indirect matériel ou corporel causé par l'utilisation de son service.
Le
membre fera sien tout litige pouvant survenir entre lui-même et toute personne
tierce aux présentes.
Dans
l'hypothèse où la responsabilité de MyAnnuaire serait
néanmoins retenue par une autorité judiciaire, le membre s'engage à répondre à
toute réclamation.
Le
membre devra indemniser MyAnnuaire à
première demande contre toute action, procédure, plainte, demande, frais
d'avocats, d'expertise, frais fiscaux, sommes jugées, dommages et intérêts
quelle que soit leur origine, directe ou indirecte, et toutes avances
effectuées, liés au non-respect par lui-même de l'un quelconque des
engagements définis aux présentes et/ou à l'utilisation de son site.

- DUREE
Le
présent contrat entre en vigueur dès l'inscription du membre et il se poursuit
pour une durée indéterminée.
6
- RESILIATION
MyAnnuaire se réserve le droit de considérer le présent contrat comme
purement et simplement résilié de plein droit sans délai et sans aucune
formalité, sans préjudice de tous dommages et intérêts en cas de non-respect de
l'une de ses clauses.
A
la résiliation du compte MyAnnuaire et à
toute fin de preuves, les données concernant l'annuaire sont conservées
confidentiellement et à titre d'archivage.
Si
MyAnnuaire décide de couper temporairement ou
définitivement le service, MyAnnuaire n’a
pas besoin de se justifier auprès de ses membres qui auront créé un annuaire
gratuitement. MyAnnuaire se justifiera simplement auprès des
abonnés qui auront souscris à un de nos différents services payant et
procèderait aux remboursements des services achetés uniquement dans le cas ou l’abonné
n’aurait pas jouie de son achat.

- GARANTIES
Le
propriétaire de MyAnnuaire ne garantit pas que le service MyAnnuaire répondra aux besoins du membre, ni qu'ils
seront exempt de toute interruption, retard, incident de sécurité ou erreur de
fonctionnement.
MyAnnuaire s'efforcera de garantir une bonne qualité de service mais
n'apporte ni garantie de service ni engagement de temps de réponse.
Le
membre est informé des risques particuliers liés à l'utilisation du réseau
INTERNET, et notamment du fait que des informations relatives à des données
personnelles le concernant peuvent être captées et/ou transférées, notamment
dans des pays n'assurant pas un niveau de protection adéquat des données
personnelles.
Le présent contrat constitue l'entier et unique
contrat entre les parties, il remplace et annule tous accords antérieurs.

- MODIFICATION DES CONDITIONS CONTRACTUELLES
Le
présent contrat est disponible en ligne à tout moment sur le site MyAnnuaire.com et ce afin de permettre au membre de
vérifier la conformité de son site avec le présent contrat.
Les
parties ont convenu que MyAnnuaire peut
de plein droit, modifier ses services et/ou les termes du présent contrat,
compte tenu notamment de l'évolution technique du service.
9
- LOI APPLICABLE
Le
présent contrat est régi par le droit anglais.
Tout
litige relatif à la validité, l'interprétation ou l'exécution du présent
contrat et après échec de toute conciliation, sera soumis aux tribunaux
compétents.
10
- DROIT DES CESSIONS
MyAnnuaire se réserve le droit de céder ou de sous-traiter sans
préavis tout ou partie des obligations du présent contrat. Le membre ne peut en
aucun cas céder le bénéfice de tout ou partie du présent contrat.
